| Ideally, success will result in a mutually
acceptable agreement, and finality.
Success through mediation, however, may also
be the reaching of a clear, well-analyzed and well-informed
decision – to agree or even not to agree – one that
you believe serves your best interests. Though unlikely,
even if you don’t reach agreement on the day of the
mediation, you still walk away with value.
For instance, through the process and with
the helpful advantage of me as the neutral mediator, you
have the safe opportunity – and the necessary
encouragement – to confront the best and worst
possible outcomes so you can make a reasoned, well-informed
decision that addresses your best interests.
Worthwhile in determining a mediation’s
success are:
- The relatively brief time you spend
- The thorough consideration of your circumstances
and alternatives
- The well-informed decisions
- The well-crafted resolution
What you gain:
- Clarity as to your choices, how they
play out, and how each comparatively serves you
- A better understanding of the barriers
to resolution
- The opportunity to express your viewpoint and
the way you believe the matter ought to be resolved
- You may enhance — even influence — one another’s
understanding and move the matter closer in the direction
of resolution
In the end, I want parties to walk away with
the satisfaction — settlement or no — of having:
- Earnestly and zealously worked toward resolution
- Made well-informed decisions that served their best interests,
and
- Covered valuable ground in the direction that they desire
to move toward
